Under the GDPR, user consent must be obtained through an explicit, affirmative action and be freely given, specific, informed and unambiguous.
Ireland’s data protection regulator noted in its annual report that many organisations use pre-checked boxes or default settings for consent to cookies and some organisations rely on the user’s implied consent to cookies – neither of which are valid under the GDPR. The report also highlighted that:
‘Given the pervasive nature and scope of online tracking and the inextricable links between such tracking and cookie technologies and AdTech, we will place a strong focus on compliance in this area.’
With TrustElevate, you can be assured of your compliance with data protection regulation with our simple plug-and-play solution
